Definitions

Goods: Tangible movable property, including water, gas, and electricity supplied in a limited volume or quantity, as well as goods containing digital elements.

Goods containing digital elements: Tangible movable property that includes or is interconnected with digital content or a digital service in such a way that, in the absence of that digital content or service, the goods would not be able to perform their functions.

Parties: The Seller and the Buyer jointly.

Consumer: A natural person acting outside the scope of their trade, profession, or business activity.

Consumer contract: A contract in which one of the parties qualifies as a consumer.

Functionality: The ability of goods containing digital elements, digital content, or a digital service to perform their intended functions.

Manufacturer: The producer of the product, or, in the case of an imported product, the importer who brings the product into the territory of the European Union, as well as any person who, by placing their name, trademark, or other distinguishing mark on the product, presents themselves as the manufacturer.

Interoperability: The ability of goods containing digital elements, digital content, or a digital service to function with hardware or software other than that with which goods, digital content, or digital services of the same type are normally used.

Compatibility: The ability of goods containing digital elements, digital content, or a digital service to function — without modification — with hardware or software with which goods, digital content, or digital services of the same type are normally used.

Website: This website, which serves as a platform for concluding the contract.

Contract: The sales contract concluded between the Seller and the Buyer using the Website and electronic communication.

Durable medium: Any device that enables the consumer or the business to store data addressed personally to them in a way that is accessible in the future for a period of time appropriate to the data’s purpose, and allows the unchanged reproduction of the stored data.

Means of distance communication: Any device suitable for making contractual statements between the parties without their simultaneous physical presence, for the purpose of concluding a contract. Such means include addressed or unaddressed printed matter, standard letters, advertisements with order forms, catalogues, telephone, fax, and devices providing Internet access.

Distance contract: A consumer contract concluded within the framework of a distance sales system organized for the supply of goods or services, without the simultaneous physical presence of the parties, by exclusively using one or more means of distance communication up to and including the conclusion of the contract.

Product: Goods and goods containing digital elements offered for sale on the Website.

Business: A person acting in the course of their trade, self-employment, or business activity.

Buyer / You: The person submitting a purchase offer and entering into a contract through the Website.

Warranty: In consumer contracts concluded between the consumer and the business, as defined by the Civil Code:

  1. A warranty voluntarily undertaken by the business, beyond or in the absence of a statutory obligation, for the proper performance of the contract; and
  2. A mandatory warranty established by law.

Purchase price: The consideration payable for the goods and for the provision of digital content services.

The Contract is governed by Hungarian law, particularly the following legal provisions:

  • Act CLV of 1997 on Consumer Protection
  • Act CVIII of 2001 on Certain Issues of Electronic Commerce Services and Information Society Services
  • Act V of 2013 on the Civil Code
  • Government Decree 151/2003 (IX.22.) on the Mandatory Warranty for Durable Consumer Goods
  • Government Decree 45/2014 (II.26.) on the Detailed Rules of Contracts Concluded Between Consumers and Businesses
  • Ministerial Decree 19/2014 (IV.29.) NGM on the Procedural Rules for Handling Warranty and Guarantee Claims for Goods Sold Under Contracts Between Consumers and Businesses
  • Act LXXVI of 1999 on Copyright
  • Act CXX of 2011 on the Right of Informational Self-Determination and on Freedom of Information
  • REGULATION (EU) 2018/302 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL (of 28 February 2018) on addressing unjustified geo-blocking and other forms of discrimination based on customers’ nationality, place of residence or place of establishment within the internal market, and amending Regulations (EC) No 2006/2004 and (EU) 2017/2394 and Directive 2009/22/EC

Scope and Acceptance of the Terms and Conditions

The content of the contract concluded between us — in addition to the provisions of the mandatory applicable laws — is governed by these General Terms and Conditions (hereinafter referred to as the “GTC”). Accordingly, the GTC defines the rights and obligations of you and us, the conditions of contract formation, performance deadlines, delivery and payment terms, liability provisions, and the conditions for exercising the right of withdrawal.

Any technical information necessary for the use of the Website that is not included in this GTC is provided in other informational sections available on the Website.

Before finalizing your order, you are required to read and understand the provisions of this GTC.

Language and Form of the Contract

The language of the contracts falling under the scope of this GTC is Hungarian.

The contracts falling under the scope of this GTC do not qualify as written contracts and are not filed by the Seller.

Electronic Invoice

Our company issues electronic invoices in accordance with Section 175 of Act CXXVII of 2007 on Value Added Tax. By accepting this GTC, you consent to the use of electronic invoices.

Prices

All prices are in Hungarian forints (HUF) and include 27% VAT. The Seller reserves the right to change prices for business or commercial reasons. Price changes do not apply to contracts already concluded. If the Seller displays an incorrect price for a product and an order is placed but the contract has not yet been concluded, the Seller will proceed according to the section “Procedure in case of an incorrect price.”

Procedure in Case of Incorrect Price

The following are considered clearly incorrect prices:

  • A price of 0 HUF,
  • A price that incorrectly displays the discount (e.g., a product with a price of 1000 HUF is shown with a 20% discount but offered for 500 HUF).

In the case of an incorrect price, the Seller will offer the opportunity to purchase the product at the correct price. Based on this information, the Buyer may decide whether to proceed with the purchase at the correct price or cancel the order without any negative consequences.
